Subletting and resident

If you let someone else use your apartment independently, it means that you are subletting your apartment.
In order to do this, you need permission from us at HSB Gambrinus. If you do not get permission from us but still sublet your apartment, you can get lose of the rental contract and be forced to move out of the apartment.
 
If you want to sublet your apartment, please submit a written application to us. The application form can be found HERE. Your application must state which period and why you want to sublet, as well as information about the subtenant. We usually give permission for subletting if you have significant reasons to rent out your apartment, as well as if we can approve the subtenant. Noteworthy reasons include, for example, that you have to move to another location due to study, work, or military service. This information, on the other hand, needs to be substantiated by certificates from schools, employers, etc.

 

Verify the subtenant before renting

It is important to verify the person you are considering renting to.  

He or she must be able to pay the rent, and you must be able to trust that it is a well-behaved person you are renting to. 

If the subtenant disturbs the neighbors, you as the first-hand tenant can lose the apartment. All claims for rectification are addressed to you as a first-hand tenant and not to your subtenant. You as the first-hand tenant are also responsible for the condition of the apartment towards us.

Make an inventory and inspect the apartments

If you are given the go-ahead to rent out the apartment to the subtenantyou should make an inventory of what furniture is to be included in the rental. 

It is also important that you carry out a joint inspection of the apartment and document any damage that exits. 

When the subletting endsyou should re-inspection to check if there have been any damage that the subtenant should be responsible for. 

The rent must be resonable

You may not charge a higher rent to the subtenant then the one you pay to us. If the apartment is furnished, you may add a maximum of 15% to the rent. If electricity, internet etc. are included in the rent when you sublet the apartment, you will only be paid for the costs that you have yourself.

If you chage higher rent from your subtenant than you are entitled to, you risk losing your apartment. In addition, if the tenancy is sublet without an additional rent and with an excessive rent, you risk a fine or imprisonment, as it is criminal from 1 October 2019. 

Apartment exchange needs to be approved

In order to exchange a tenancy for another tenancy, you need permission from the landlord, or from the rent board. Both you as a tenant and the person you want to change the apartment with also need to have lived in the apartment for 1 year in order for the rent board to approve the change. The Rent Board does not approve the change of tenancy for a tenant-owned apartment or villa. 

Selling or buying a lease is a crime

It is a crime to sell or buy a lease, for example to charge for tenancy in connection with apartment change.
 
It is also forbidden to pay a tenant, broker or other person to get a lease.
 
The penalty for selling or buying a lease is a fine or imprisonment!
 

You must register the population registration address

You should be registered where you live.

Since 1 July 2018, it is a crime to provide incorrect information or not to report changed population registration data to the Swedish Tax Agency when moving.

The penalty is a fine or imprisonment.
